This website is operated by CareerSet Ltd. Throughout the site, the terms “we”, “us” and “our” refer to CareerSet and its subsidiaries or affiliates. CareerSet offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or using our online tools and services, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all visitors and users of the Site, without limitation.

Please read these Terms of Service carefully before accessing or using our Website. By accessing or using any part of the Site, you agree to be bound by these Terms of Service. CareerSet reserves the right to refuse service to anyone for any reason at any time. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.


Introduction

It is our goal is to enable users (i.e. jobseekers, students, professionals) to write better CVs. We are able to do this by making available via our Site:
1) a CV analysis engine that uses advanced machine learning, artificial intelligence and natural language processing techniques to parse uploaded CVs and identify errors, issues and improvement possibilities, made available to users via feedback reports;
2) a searchable database of sample CV lines that have been selected by experienced professionals, hiring managers and career advisors;
3) other useful and relevant resources, including but not limited to CV checklists, CV templates, action words and metrics that allow users to quantify their work experiences.

All features, services and content on this Website aim to help users improve their CV and employability.   Please note however that CareerSet does not warrant that the use of our site will provide any specific or desired results. CareerSet makes no representations or guarantees regarding the effectiveness of the site in meeting a user’s employment objectives.


Eligibility

You must be of the age of majority in your jurisdiction (country, region, state or province of residence) in order to use the Site or Services provided therein in any manner. By using the Site and accepting these Terms of Service, you represent and warrant that you have the right, authority and capacity to agree to and abide by these Terms of Service. You also represent that you will use the Site and any services in a manner consistent with any and all applicable laws and regulations. 


Accounts

When you register via our Site, login via a single sign-on account (e.g. your university’s login details), Google or Facebook, we automatically create a unique user account for you on our Site. As a registered user, you agree to: 
(1) keep your password secure and confidential;
(2) use our Site and/or Services directly and strictly only for the authorised purpose, and not for any other individual or entity;
(3) not use a fake/false identity (one that is not yourself);
(4) not permit others to use your account;
(5) not use someone else's account(s);
(6) not share account(s);
(7) not sell, trade, or transfer your our account to another party;
(8) not charge anyone for access to any portion of our Site and/or Services, or any information or services therein;
(9) not intentionally upload a CV or any other document whose content is not your own;
(10) not request contact to an email address or contact information that is not your own;
(11) not take any action that imposes an unreasonable or disproportionately large load on the Site's infrastructure;
(12) follow all applicable rules and regulations; and general conduct stated in these Terms of Service.
You are solely responsible for all the activities performed on/using your account unless you report misuse.

You must notify us immediately of any breach of security or unauthorised access of your account.


Modifications to the Service

We reserve the right, at our sole discretion, to change, modify or otherwise alter the Terms and Conditions set forth in these Terms of Service at any time and you agree to be bound by such changes, modifications or alterations. Such modifications shall become effective immediately upon the posting thereof on the Site and/or Services. Your continued use of our Site and/or Services after any changes will signify and confirm your acceptance of those changes.

We aim to create the best experience for our Users. Therefore, the Site and/or Services provided may change which includes, but is not limited to, updates, upgrades or discontinuation of features, components or modules, without prior notification, as part of our effort to update, improve and expand the Site and/or Services. 

CareerSet is not obligated to inform you of any such changes and you are solely responsible for periodically checking the Site and/or Services for changes. 


Acceptable Use Policy

Authorised Use: CareerSet authorises you to view and access a single copy of the content available on or from the Site solely for personal use. Only one individual may access the Website using the same email or password, as stated in the Accounts section above.  Any recommendations or advice provided by us on the Site and/or Services is for informational purposes only and CareerSet expressly excludes any liability for any action taken by a User based on such recommendations or advice. 

Use of Site Content: The contents of this Site such as text, graphics, images, logos, button icons, software and other content (collectively the "Site Content") are protected under both United Kingdom and foreign copyright, trademark and other laws. All such content is the property of CareerSet or its content suppliers. Unauthorised use of the Site Content may violate these laws and is strictly prohibited. Users must retain all copyright, trademark, service mark and other proprietary notices contained in the original Site Content on any authorised copy they make of such content. Users may not sell or modify the Site Content or reproduce, display, publicly perform, distribute, or otherwise use the Site Content in any way for any public or commercial purpose, in connection with products or services that are not those of CareerSet or in any other manner that infringes CareerSet’s intellectual property rights. CareerSet reserves the right, in our sole discretion, to immediately revoke your account and/or seek all other legal remedies available for copying copyrighted text or otherwise misusing or misappropriating site content, including but not limited to, use on a "mirrored", competitive, or third-party site. 

Except as otherwise expressly permitted in this Terms of Service, you agree that you will not give access to, forward, display, post or distribute any part of the Site Content to any individuals or companies. You agree that you will not use the Site and/or Services to forward, display, post or distribute any part of the Site Content or the recommendations of improvement to any public website including but not limited to social media websites. 

Prohibited Uses: You must not misuse the Site by knowingly introducing viruses, trojans, worms, malware, logic bombs or other material which is or may be malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Website is stored or any server, computer or database connected to the Website. 

The Site and/or Services may contain links to third party websites that are not owned or controlled by CareerSet. CareerSet has no control over, and assumes no responsibility or liability for, the content, privacy policies, terms of use or practices of any third-party websites. Users are solely responsible for reading and agreeing (or disagreeing) with the terms and conditions and/or privacy policies of these third-parties.



Software and Technology

CareerSet’s software and technology ("Software") includes the Site and/or Services hosted on CareerSet.com and accessed via the Internet. CareerSet agrees to provide you with a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software in accordance with these Terms of Service. You may not use the Software for anything other than as intended by CareerSet. You may not use the Software with any device, program or service designed to circumvent technological measures employed to control access to, or the rights in work protected by copyright laws. All rights not expressly granted by CareerSet are hereby reserved. You agree not to take any action to interfere with CareerSet’s ownership of or rights in the Software. You agree that, unless otherwise permitted in this section or by law, you will not: 
(a) reproduce, republish, display, frame, download, distribute, copy or transmit the Software; 
(b) to the extent permitted under applicable law, redistribute, encumber, sell, rent, lease, loan, sublicense, assign, or otherwise transfer rights to the Software;
(c) modify or create any derivative works based on the Software, including but not limited to customisation, translation, or localisation;
(f) attempt to probe, scan or test the vulnerability of the Software or any associated system or network, or breach any security or authentication feature or measure of the Software;
(d) copy, reproduce, reuse in another product or service, modify, alter, or display in any manner any software or files, or parts thereof, included as part of the Software;
(e) except to the extent expressly permitted by law, decompile, disassemble, reverse engineer, or otherwise attempt to access or derive the source code or architecture of the Software, or in any way ascertain, decipher, or obtain the communications protocols for accessing the Software, or the underlying ideas or algorithms of the Software;
(g) attempt to gain unauthorised access to the Software or to any account, application, platform, computer system or network associated with the Software (and, if you are blocked by CareerSet from accessing the Software, such as if CareerSet blocks your IP address, you will not implement any measure to circumvent such blocking, such as by masking your IP address or using a proxy IP address);
(h) use the Software in any way that violates these Terms of Service, or any applicable law or regulation; and


Disclaimer of warranties

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall CareerSet, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost earnings, lost profits, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any features procured using the service, or for any other claim related in any way to your use of the service or any feature, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.


Indemnification

You agree to indemnify, defend and hold harmless CareerSet and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

Termination of your Account

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

CareerSet reserves the right to refuse service to terminate your account without notice if: (a) CareerSet determines that you have violated these Terms of Service, (b) CareerSet is requested or required to do so by any court of competent jurisdiction or government authority in any country, (c) if you are no longer directly associated with the party that entered into a licensing agreement with CareerSet and made account registration available to you (e.g. a university, company or other type or organisation) or (d) if such an agreement is suspended or ended.

You agree that the Site and/or Services are not intended to act as an indefinite information repository and, therefore, CareerSet may, upon such termination, deactivate or delete your account and any related data, information, and files, and bar any further access to such data, information, and files. Such action may include, among other things, accessing your content or data and/or discontinuing your use of the Site and/or Services without compensation. 


Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

These Terms of Service will be governed by and construed in accordance with the law of England and Wales. All disputes arising under the Terms of Service will be subject to the exclusive jurisdiction of the English and Welsh courts.
